Please read these Terms and Conditions carefully. Your use of this site (and its links) means that you expressly agree to be bound by this agreement. In addition, you agree to be subject to all additional disclaimers and caveats that appear anywhere throughout the site.

1. Definitions

In this agreement:

"Agreement" means these terms and conditions of use as may be amended from time to time.

"CarrierWeb Ireland Limited" and "carrierweb.com" means CarrierWeb Ireland Limited, and all of its affiliates. CarrierWeb Ireland Limited is a company incorporated in Ireland with registered number 354123, having its registered office at 19 Lower Baggot Street, Dublin 2, Ireland.

"Content" means the information content on this site.

"Experts" means the members of CarrierWeb and CarrierWeb Ireland Limited personnel who provide the answers to most of the queries submitted via the Contact Support pages. Occasionally, other professional advisers are consulted for answers to certain topics. CarrierWeb and CarrierWeb Ireland Limited make no warranties or representations of whatsoever nature arising in relation to the reliability, accuracy, truthfulness, relevance, usefulness, suitability, adequacy, timeliness or completeness of information obtained via the Contact Support pages.

2. User obligations

You will use this site appropriately and in accordance with these terms and conditions and all other applicable laws, licenses and regulations. In particular you will not directly or indirectly place on the website anything or do anything as the case may be while using the site in relation to its Content that includes but is not limited to the following:
  • Infringes on the intellectual property rights or related rights of any third party or any rights of publicity or privacy
  • Violates any law, statute or regulation
  • Is defamatory, libelous, unduly disparaging of goods or services, unlawfully threatening or unlawfully harassing
  • Is obscene, pornographic, offensive or menacing or is otherwise contrary to public policy or order
  • Contains any viruses, Trojan horses, worms, time bombs, cancel box or other computer programming routines that damage (or are intended to damage), interfere with, surreptitiously intercept or expropriate any system, data or personal information ("Offending Content")
  • Contains pirated software or constitutes an act of software piracy
  • Constitutes unsolicited mailbombing or spamming or causes annoyance, inconvenience, nuisance or anxiety to CarrierWeb, CarrierWeb Ireland Limited, its promoters, contractors, employees, advisors or agents, or other internet users
  • Enables any hacking.
2.1. The User is, and at all times shall be, an end user of the Service, and the User shall not resell or sub-license in exchange for payment the service or information provided on the carrierweb.com website to any third party without the written permission of CarrierWeb and/or CarrierWeb Ireland Limited. The User is responsible for the actions of any person who avails of this service or accesses the information through the User's registration with CarrierWeb.

2.2. The User will comply with all reasonable instructions given by CarrierWeb from time to time in connection with the use of the service.

3. User indemnity

The user shall indemnify CarrierWeb, CarrierWeb Ireland Limited, its promoters, contractors, servants, employees, advisors or agents, against any and all losses of whatsoever nature (including, but not limited to, direct and indirect loss, consequential loss, economic loss, loss of profits, loss of business, loss of contracts, loss of revenue, loss of anticipated savings, loss of goodwill or loss of reputation), liabilities, claims, damages, settlements, awards, costs, expenses and proceedings incurred by CarrierWeb, its promoters, servants, employees and/or agents in consequence of the user's use or misuse of this site or the information or the resources contained on or accessible through this site or infringement of intellectual property rights, and/or by reason of any breach of these terms and conditions of use and/or due to the act, error, omission, default or negligence of the User or of any third party who has access to this site via the User's connection or otherwise howsoever arising.

4. CarrierWeb's and CarrierWeb Ireland Limited obligations

This service and information is provided without any warranties or guarantees. All implied conditions, terms and warranties that may arise under Statute, custom, usage, in equity, tort, at common law or otherwise, are hereby expressly excluded to the fullest extent permitted by law. User confirms that this is fair and reasonable. CarrierWeb and CarrierWeb Ireland Limited do not warrant that the supply of this service and information shall be without interruption or deterioration or that reconnection can be achieved within any specific time or period or that any network through which internet connection is achieved will at any time in the future be accessible and compatible with this service, or will continue to operate as it does currently.

4.1. CarrierWeb and CarrierWeb Ireland Limited have no editorial relationships with any link sites. Accordingly, we make no warranties, representations or guarantees about them, or any products, content or services which may be provided through any link sites. Furthermore, the inclusion of these links is not intended to reflect the importance of, or vouch or warrant, these other sites or endorse any of the views expressed in, or products or services offered by, such sites. For the avoidance of doubt, CarrierWeb and CarrierWeb Ireland Limited are not the provider, seller, reseller, disseminator or agent of any of the goods or services offered for sale on any of the sites with links to or from the site and neither do CarrierWeb and CarrierWeb Ireland Limited warrant or make any representations, warranties or otherwise in any manner whatsoever about any of such goods or services.

5. Exclusion of liability

CarrierWeb and CarrierWeb Ireland Limited shall not be liable to the User or any third party for any losses of whatsoever nature (including, but not limited to, direct and indirect loss, consequential loss, economic loss, loss of data, loss of profits, loss of business, business interruption, loss of contracts, loss of revenue, loss of anticipated savings, loss of goodwill or loss of reputation), whether based on breach of contract, tort (including negligence), product liability, statute, equity or common law, or howsoever otherwise arising out of or in any way connected with the use, performance or contents of this site or any other site. We do not guarantee the accuracy or completeness of any information on this or any other internet sites and shall not be liable in any way to you for their use or performance or reliance on same. However, nothing in this Agreement shall exclude or restrict liability of either party for death or personal injury resulting from gross negligence.

For the avoidance of doubt and without prejudice to any other provisions contained in these terms and conditions, CarrierWeb and CarrierWeb Ireland Limited disclaim all express or implied representation or warranties regarding the information, services, products, materials and any other resources available on or accessible through this site, including (without limitation) any implied warranties of merchantability, fitness for a particular purpose or non infringement. All such information, services, products, materials and other resources are made available "as is" and "as available" without any representation or warranty of any kind.

CarrierWeb and CarrierWeb Ireland Limited disclaim all responsibility and liability of any description, including without limitation, liability for negligence, incidental or consequential damages and/or loss suffered by any person acting or refraining from action as a result of or in connection with this site, to include any reliance placed by such person on such material, or the viewing or use or performance of this site.

CarrierWeb and CarrierWeb Ireland Limited assume no responsibility for computer systems, hardware, software or program malfunctions or for other errors, failures or delays in computer transmissions or network connections that are human or technical in nature, or for lost, late, or otherwise damaged or misdirected information. CarrierWeb and CarrierWeb Ireland Limited, reserve the right, in their sole discretion, to cancel or suspend this program at any time without notice should a virus, bug or other causes beyond CarrierWeb's or CarrierWeb Ireland Limited control corrupt the administration, security or proper function of this program.

CarrierWeb and CarrierWeb Ireland Limited shall have no responsibility or liability to the User for any errors or interruptions in (or any delay in reinstatement of) the Service, whether arising out of a failure of any telecommunications lines, operated by any telecommunications operator, or hardware/software service interface, other connection points of any other network providers equipment or services or of any other network.

6. Commencement, term and termination

CarrierWeb and CarrierWeb Ireland Limited may disconnect this service at any time without notice to the user if:
  • The user is in breach of any terms of this Agreement
  • The user is suspected of an involvement with fraud or acts which are of a defamatory, offensive, abusive, obscene, menacing, unsuitable or unlawful character in connection with the use of the Service; or
  • CarrierWeb and CarrierWeb Ireland Limited are required by the order of any court or regulatory authority to discontinue the provision of this service, or is deemed necessary by CarrierWeb and CarrierWeb Ireland Limited to disconnect the service in order to prevent the commission of any offence or the continuance of any unlawful activity.
In addition and as CarrierWeb's and CarrierWeb Ireland Limited absolute right, CarrierWeb and CarrierWeb Ireland Limited may terminate this Agreement and/or discontinue this service immediately at any time and without notice at CarierWeb's and CarrierWeb Ireland Limited sole discretion.

7. Intellectual property

You confirm and acknowledge that all copyright, trade marks (registered or unregistered) and other intellectual property rights of whatsoever nature arising from all materials, content and information on this site, including the site's design, layout and organization, are owned or licensed by CarrierWeb Ireland Limited. Except as stated herein none of the material may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form by any means, including but not limited to, electronic, mechanical, photocopying, recording or otherwise without the prior written permission of CarrierWeb Ireland Limited.

8. Amendment

CarrierWeb and CarrierWeb Ireland Limited reserve the right to amend these terms and conditions at any time. Any such amendments will be valid immediately once they are posted on the CarrierWeb website. This Agreement cannot be otherwise altered without prior consultation with CarrierWeb and CarrierWeb Ireland Limited.

9. No waiver

Failure to act with respect to any breach of any rule whatsoever by you or any other user shall in no way effect our future right to act with respect to future similar breaches.

10. Severability

In the event that any provisions of this Agreement are held to be unenforceable, illegal or void in whole or in part, the remaining portions of the Agreement shall remain in full force and effect.

11. Governing law

This Agreement and the resolution of any dispute related to this Agreement or this site shall be governed by and construed in accordance with the Law of Ireland, and the parties hereby submit to the exclusive jurisdiction of the Irish courts for all matters arising in connection with or in any way related to this Agreement.

12. Notices

Written notice under this Agreement is satisfied by the sending of an electronic message with confirmed delivery to (in the User's case) the email address registered with CarrierWeb, or (or in the case of CarrierWeb and CarrierWeb Ireland Limited) to info@e-freightrac.ie.

13. Data protection

CarrierWeb and CarrierWeb Ireland Limited will comply with their obligations under the Data Protection Act, 1988 and any other applicable legislation. Any information about the User obtained by CarrierWeb and CarrierWeb Ireland Limited and registration for the Service or through the user of the Service will be retained and used by CarrierWeb and CarrierWeb Ireland Limited for its own internal purposes (to include monitoring use of the Service, traffic management purposes, service upgrades etc). CarrierWeb and CarrierWeb Ireland Limited may also use any information obtained from the User for purposes of marketing CarrierWeb's, CarrierWeb Ireland Limited and other party's products and services and the information may be supplied to any credit reference agency or bureau or where required by law to any governmental agency or body.
